Important Facts for Trucking Companies
- As of 1 January 2003 the Government implemented the New Entrant program for new trucking companies. This helps prepare these companies start out on the right foot.
- They are given a Safety Audit (SA) (with-in the first 18months of operation) that is basically free of any fines and/or penalties.
- This does not apply to companies that have existed prior to the above mentioned date.
- Existing companies go through a regular Compliance Review (CR) which may result in civil fines and/or penalties.
- The application of your United States Department of Transportation (US DOT) number has a clause that stipulates that your trucking company will comply with all rules and regulation of the Department of Transportation. Federal court verdicts against nationally known carriers using the Federal Statutes to enforce DOT’s Regulations to the tune of up to 10 years in prison and $500,000 in fines.
- Companies also face fines as high as $500,000 on each count. Cases have lead to even tougher enforcement by the DOT Inspector General’s Office.
If you haven’t been audited, you must be prepared.
- Each state is training personnel to perform these Safety Audits (SA) and Compliance Reviews (CR). NAFTA (USA, CANADA AND MEXICO) has adopted DOT’s rules and regulations, even if you only operate in your own state, these regulations still apply.
